These terms and conditions are entered into and agreed upon by both Seller and Buyer, who acknowledge the moral and legal worth of this contract.

                                                    AGREEMENT

In consideration of a purchase price of _______________________, the Breeder transfers all rights, privileges and responsibilities associated with the ownership of the above described puppy to the Buyer with the following conditions subsequent.

GUARANTEES BY THE BREEDER
1. This Borzoi puppy is AKC registerable and the Breeder will furnish the AKC papers, pedigree and photo of sire and dam.

1a.PET QUALITY: Breeder may retain the AKC papers until the spay/neuter terms of this agreement have been met.

2. FOR SHOW QUALITY ONLY: This Borzoi puppy is show quality as determined by the AKC Standard. If the puppy is determined not to be show quality as it grows up, it will be replaced by a show quality puppy from the next available litter. If there is a conflict between Breeder and Buyer as to the merit of this puppy, the decision will rest with a mutually agreed upon AKC judge, professional handler, or Borzoi breeder.

3. This Borzoi puppy is free from genetic health problems with eyes and hips. In the event of a genetic health problem, Breeder only requires 1. a statement from the Buyers Vet, and a copy of medical records and test reports regarding the diagnosis confirming the problem, and 2. proof that the dog is spayed/neutered. Should the veterinarian state that the health condition was caused by or contributed to by poor nutrition, an accident or injury, or anything beyond the scope of the Breeder’s responsibility, the health guarantee will be null and void.

4. SHOW QUALITY: A replacement puppy of equal or greater value OR a refund to pet price will be given, at the Breeders discretion. Buyer will be allowed to keep spayed/neutered original puppy.

5. PET QUALITY; Pets are guaranteed for the first 5 years against any problem so severe that it prevents the animal from living a normal life as a pet: PRA eye disease, Hip Dysplasia. Buyer will receive a refund of 1/2 of the pet price.

GUARANTEES BY BUYER

_____1. Buyer agrees to exercise normal care in maintaining this puppy’s health. Routine preventative care includes the following: annual exams by a licensed veterinarian, annual vaccinations, annual fecal exams, and continual heartworm prevention if indicated by veterinarian. Normal care assumes that the Buyer will feed and provide fresh water for this dog, exercise in a fenced enclosure, as well as give attention and love to this dog on a daily basis.

_____2. This puppy will receive adequate socialization and training to make it a good pet. Buyer agrees that this animal is NOT to be left crated for unreasonable periods of time. Buyer avows that this animal will become a member of the family. This is to assure proper socialization and the happiness and well being of the animal.

_____3. This puppy will NEVER be permitted to roam at large. This dog will be allowed exercise in a secure fenced yard or field on a daily basis.

_____4. If Buyer is found to be abusing or neglecting this dog by not following these MOST BASIC guidelines as outlined in terms 1 through 3, the ownership of the dog will immediately revert back to Breeder who may immediately assume Possession of the dog. Breeders reasonable attorney fees for recovery of the dog in such a situation will be paid for by the Buyer.

_____5. FOR SHOW QUALITY BITCHES ONLY, This puppy will not be bred until she reaches her 2 nd birthday or 3rd heat cycle. Buyer promises to place any PET puppies out of this bitch on limited registration and spay/neuter contracts. No puppies out of this bitch will be sold or given to pet stores, puppy mills, commercial breeders, or any type of "resale" operation. If there are any puppies found being disposed of through these methods, or if pet puppies are found to be sold on full registration without spay/neuter agreement the Breeders reputation will be damaged.

_____6. IF BUYER IS UNABLE TO KEEP THIS PUPPY, FIRST OPTION TO TAKE THIS DOG BACK MUST BE GIVEN TO THE BREEDER . Puppy cannot be sold or given away without the Breeders full knowledge and written permission. Should the Buyer return the puppy for whatever reason. Buyer is responsible for all shipping costs. The Breeder may then opt to: 1. replace the puppy with another of similar quality at a later date, 2. if the return occurs anytime during the first year after purchase, refund the original purchase price of the puppy should the Breeder decide to keep the puppy herself, or 3. sell the puppy and at that time give Buyer the money. If option 3 is chosen, every effort will be made to recoup the original purchase price. This decision is exclusively the Breeder’s. NOTE; ANY REFUND GIVEN WILL BE MINUS *ALL* BREEDERS EXPENSES, including but not limited to getting vaccinations up to date, any vet expenses, and advertising to re-home.

_____7. FOR SHOW QUALITY MALES ONLY. Buyer agrees to only breed this male to other purebred registered Borzoi. And only breed to females of quality who are owned by trustworthy and responsible people. The owners of the bitches must agree to place all pets resulting from litters sired by this dog as limited registration and on spay/neuter contracts.

_____8. This dog is NOT to be offered for sale or euthanized in a non-emergency situation without express written permission from the Breeder. This dog will never be sold or given to a research facility. This dog is NOT to be placed in a shelter or humane society or turned over to a rescue organization.

_____ Any failure to comply with the terms included in #’s 5, 6, 7,and 8 will result in the Breeders reputation being damaged. Damages of $2500 per puppy will be owed immediately to Breeder. Breeders reasonable attorney fees for recovery of the dog or collection of the fine will be paid by the Buyer. Additionally, rights and ownership of the dog will immediately terminate and revert back to Breeder who may immediately assume Possession of the dog.

_____9. Buyer agrees to notify Breeder in writing if the puppy displays any genetic defect as determined by a licensed veterinarian at any time during the life of the dog.

_____10. Buyer agrees that as a condition to the sale of this puppy, it will be named Dar Morev’s _____________________________________________. Buyer may use any call name for the puppy.

_____11. FOR SHOW QUALITY MALES ONLY. The Breeder reserves the right to use the dog at stud. Free of charge, to result in a litter consisting of 2 live pups at 2 weeks of age. The Breeder may only use bitches owned or co-owned by herself with this dog. As many as 4 different attempts may be tried to achieve this. All expences such as boarding, Ai's, health checks &/or certification, & shipping will be born by the Breeder.

_____12. FOR PET PUPPIES ONLY. This pet Borzoi puppy is PET quality as determined by the AKC standard. Therefore it is being placed on limited registration. Buyer should understand that "limited registration" means that the Buyer cannot show this puppy in AKC Conformation shows and Buyer cannot breed this puppy, It is understood that this puppy is sold only as a family companion, and is not intended or represented by the breeder as a show or breeding animal.

_____ 13. FOR PET PUPPIES ONLY: this puppy will be spayed/neutered before he/she is 10 months old. Veterinarian proof of spay/neuter will be mailed to Breeder. This requirement if spay/neuter is a condition to the sale of this puppy, and was reflected in the original purchase price. Therefore, if this part of the contract is not complied with, Buyer owes Breeder the difference between show and pet price which, is a total of ________________.

_____14. All shipping expenses including health certification shall be the responsibility of the Buyer.

Breeder is not responsible for errors or mishandling during shipping.

_____15. Buyer agrees that this contract will be bound by the laws of the State of Washington, and that any dispute regarding this contract will be settled in a Washington court.
